Terms of Service

These Terms of Service govern the use of the Digital Signage platform "Screenify" between bitneo GmbH and the customer.
1. Subject Matter
Screenify provides a cloud-based software platform for managing and controlling Digital Signage displays. The service includes device management, upload and management of media content, creation of playlists, scheduling and statistics.
2. Registration and Contract Formation
The contract is formed by registration and selection of a license model. By registering, the customer confirms having read and accepted these Terms of Service.
3. Availability
We provide the service with an average availability of 99% per year. Planned maintenance will be announced when possible.
4. Payment Terms
Prices are based on the selected license model and number of devices. Payments are made monthly or annually via Stripe (credit card) or by invoice as agreed (30 days payment term).
5. Cancellation
Stripe subscriptions can be canceled at any time. Cancellation takes effect at the end of the current billing period. Invoice customers: individual cancellation terms as per contract.
6. Customer Obligations
The customer commits to lawful use, protecting access credentials and ensuring uploaded content does not violate third party rights.
§6.4 Freemium Multiple Accounts
Only one freemium licence may exist per registered domain at any time. Multiple registrations will be flagged and may be deactivated without prior notice. This restriction does not apply to paid licences.
7. Content Rights
The customer retains all rights to uploaded content. By uploading, the customer grants us a non-exclusive right to store content and deliver it to their devices.
8. Liability
We are liable according to statutory provisions for intent and gross negligence. For simple negligence, liability is limited to typical, foreseeable damages.
9. Privacy
The processing of personal data is carried out in accordance with our Privacy Policy and applicable data protection laws (GDPR). Privacy Policy.
10. Final Provisions
Swiss law applies. Jurisdiction is the registered office of the provider. Changes to these Terms will be announced with 30 days notice.
